Sales, Delivery & Installation Agreement
These are the same terms used for Sea Turtle Palms estimates, invoices, Square contracts, and online orders.
Sea Turtle Palms LLC sells, delivers, and professionally installs palm trees. We are not a full-service landscaping company. Our work is limited to the palms, materials, and services specifically listed in the accepted Estimate or online order.
1. Included work
Unless otherwise stated, palm installation includes delivery of the listed palms, placement and planting, a finished soil berm where site conditions permit, removal of debris generated by Sea Turtle Palms, and reasonable cleanup of the immediate installation area.
2. Work not included
Unless specifically listed as a line item, the price does not include mulch; full landscape design or work unrelated to palm placement; irrigation or drainage installation, relocation, or repair; grading, edging, sod, or landscape-bed renovation; removal of existing plants, shrubs, roots, stumps, rocks, or unsuitable soil; full-yard cleanup or ongoing property maintenance; permits or HOA approvals; or work outside the immediate palm-installation area. Additional work requested by the customer must be approved in writing and may result in additional charges.
3. Property access and underground systems
The customer will provide safe and adequate access for Sea Turtle Palms personnel, trucks, trailers, and equipment. The customer must disclose and clearly identify private irrigation, drainage, lighting, electrical, cable, pool, septic, invisible-fence, and other underground systems near the work area. Sea Turtle Palms will exercise reasonable care but is not responsible for damage to unmarked or undisclosed private systems, except to the extent caused by our negligence.
4. Palm and placement approval
Palms are living plants and naturally vary in height, trunk shape, fullness, color, and appearance. Photographs are representative and do not guarantee an identical specimen. The customer will have the opportunity to approve the palms and final planting locations before installation begins. If the customer or an authorized adult is not present, a location previously approved by Estimate, order, text, email, or site instructions constitutes placement approval.
5. Cancellation and final sale
Except for any cancellation right that cannot legally be waived, cancellation must occur before the palms are delivered to the property or installation begins. Once the palms have been delivered or installation has begun, the order is final and no voluntary returns, exchanges, cancellations, or refunds will be provided. This does not eliminate a legitimate claim if Sea Turtle Palms fails to provide the goods or installation services listed in the accepted Estimate or order.
6. Palm care and warranty
After installation, the customer is responsible for properly watering and maintaining the palms and should follow the Sea Turtle Palms care guide. Unless a separate written warranty is specifically included, Sea Turtle Palms does not guarantee the survival or future appearance of living plants and is not responsible for loss or damage caused by improper watering or care, transplant shock, freeze, frost, drought, flooding, storms, severe weather, pests, disease, animals, chemical or fertilizer exposure, irrigation failure, or third-party activity.
7. Scheduling and availability
Installation dates are estimates and may change because of weather, unsafe site conditions, equipment access, utility conflicts, plant availability, route availability, or circumstances beyond our reasonable control. If an item is unavailable, no substitution will be made without customer approval. A reasonable scheduling delay does not constitute abandonment or breach.
8. Site conditions and changes
Changes to palm selection, quantity, placement, materials, site access, or scope must be approved in writing. Additional labor, materials, equipment, removal, or disposal required because of concealed or undisclosed site conditions or customer-requested changes may result in additional charges. Difficult access, roots, rock, buried debris, unsuitable soil, hardscape, or special-equipment needs will be discussed with the customer before added work is performed.
9. Payment
Website orders are paid in full at checkout. For accepted Estimates, a 25% deposit is due upon acceptance and applied toward the total price. The remaining 75% is due immediately upon substantial completion of the listed installation work. Minor cleanup or correction items do not postpone payment for completed work. Approved additional work is due upon completion.
10. Promotions and qualifying service
Free standard delivery and installation applies only to qualifying orders under standard site conditions within the stated service area. Difficult access, special equipment, removal work, oversized specimens, unusual site conditions, or service outside the normal area may cost extra with customer approval.
11. Acceptance and entire agreement
By signing, initialing, electronically accepting an Estimate, or checking the required online agreement box, the customer authorizes Sea Turtle Palms to perform the listed work; confirms that the Estimate or order accurately describes the requested work; accepts these Palm Sale and Installation Terms; and agrees to pay the stated price. The accepted Estimate or online order, these terms, and approved written changes form the complete agreement. Florida law governs. Electronic acceptance and signatures are valid.
